Artificial Intelligence Usage Policy

This Policy explains how RefinAI uses generative AI to process images, what the technology's limitations are, and what responsibilities users have when sending, generating, sharing, or publishing visualizations created on the platform. It complements the Terms of Use, Privacy Policy, Cookie Policy, and Credit Usage Policy.

1. Purpose of this policy

This Artificial Intelligence Usage Policy explains how RefinAI uses generative AI to process images, what the technology's limitations are, and what responsibilities users have when sending, generating, sharing, or publishing visualizations created on the platform.

This policy complements the Terms of Use, Privacy Policy, Cookie Policy, and Credit Usage Policy.

2. Nature of generative AI

RefinAI uses generative artificial intelligence systems and third-party providers to transform user-submitted images into refined architectural visualizations.

Generative AI is probabilistic. Therefore, generated images may contain errors, visual artifacts, inconsistencies, unintended alterations, inaccurate interpretations, or results that differ from expectations.

RefinAI does not guarantee: technical, constructive, structural, or regulatory fidelity; absence of errors, artifacts, or distortions; absolute originality or exclusivity of the generated image; absence of similarity with third-party works, environments, styles, brands, images, or projects; acceptance by clients, platforms, social networks, public agencies, or third parties; suitability for construction, legal project, technical report, or professional document.

3. Mandatory human review

Images generated by RefinAI must be reviewed by the user before any public, commercial, professional, contractual, advertising, institutional use, or client presentation.

RefinAI is a visual and creative support tool. It does not replace the professional judgment of architects, designers, engineers, developers, builders, or other technical professionals.

The user is responsible for verifying whether the generated image is suitable for their context, including dimensions, materials, architectural solutions, structural elements, applicable standards, third-party rights, contracts, and authorizations.

4. Images submitted by the user

By submitting an image to RefinAI, the user declares that they have sufficient rights, licenses, authorizations, or legal basis to use and process that image on the platform.

This includes, when applicable: images of architectural projects; renders, sketches, blueprints, photographs, models, and studies; images of interiors, facades, land, properties, or developments; trademarks, logos, artworks, furniture, products, or protected elements; images belonging to clients, partners, offices, suppliers, or third parties.

Users should not submit confidential images, sensitive data, contractually protected information, or third-party content without proper permission.

5. Outputs generated by RefinAI

Users may use images generated by RefinAI for personal, professional, or commercial purposes, as long as they comply with the Terms of Use, this policy, applicable laws, and third-party rights.

The user remains responsible for the final use of the generated images, including publication, client presentation, portfolio use, advertisements, commercial materials, social media, websites, proposals, studies, or documents.

RefinAI does not perform legal clearance, copyright verification, trademark verification, technical engineering validation, urban planning validation, or professional approval of generated images.

6. Prohibited content

It is prohibited to use RefinAI to create, edit, store, share, or disseminate content that: is illegal, fraudulent, misleading, defamatory, discriminatory, threatening, or abusive; violates copyrights, trademarks, trade secrets, image, privacy, or personality rights of third parties; involves nudity, sexual content, child exploitation, abuse, harassment, extreme violence, or hate speech; depicts real people without authorization when this could cause harm, confusion, false endorsement, fraud, or rights violation; manipulates documents, credentials, evidence, records, or information in a deceptive manner; is used for scams, social engineering, phishing, malware, system intrusion, or fraud; circumvents filters, limits, security, billing, Refins, or moderation mechanisms on the platform.

RefinAI may block, remove, review, or report content and accounts when there is suspicion of abuse, legal risk, rights violation, or non-compliance with this policy.

7. Real people, brands, and third-party property

Users must have authorization before submitting or generating content that identifies real people, brands, protected works, developments, private facades, third-party interiors, or client projects.

When the image involves third parties, the user is responsible for obtaining consents, licenses, contractual approvals, and necessary authorizations before publishing, selling, disclosing, or commercially exploiting the image.

8. Third-party providers and processing

To generate images, RefinAI may process inputs, configurations, and outputs through third-party providers of AI, storage, database, hosting, payments, and communications, including providers that may process data outside Brazil.

The processing of personal data, images, prompts, and logs follows RefinAI's Privacy Policy, Cookie Policy, and internal processor inventory. The user acknowledges that availability, quality, limits, filters, policies, technical retention, and model performance may depend on external providers.

9. Filters, moderation, and technical limitations

RefinAI may use automated filters, validations, usage limits, auditing, manual review, blocks, and security mechanisms to reduce abuse, fraud, spam, prohibited content, or operational risk.

These mechanisms may fail, block lawful content by mistake, or fail to detect inappropriate content. The existence of filters does not transfer responsibility for user-submitted, generated, selected, or published content to RefinAI.

10. Public sharing via link

RefinAI visualizations remain private by default. A visualization only becomes publicly accessible when the user creates or activates a public sharing link.

When creating a public link, the user chooses which credits to display, such as name, studio name, Instagram, and website. The user can deactivate sharing at any time.

Public links must not expose internal IDs, storage paths, prompts, internal configurations, Refins, financial data, user email, or information not authorized by the user.

Link deactivation prevents new public access via the shared route, but does not necessarily eliminate copies, screenshots, caches, or shares made by third parties while the link was active.

11. Submit for Featured

Submitting an image for Featured is voluntary and free. By submitting a visualization for evaluation by the RefinAI team, the user confirms they have authorization to submit and disclose the image and authorizes RefinAI to use it in its promotional channels, with credits when applicable.

RefinAI may evaluate, select, not select, or publish images submitted for Featured according to internal criteria of quality, suitability, brand, risk, and curation.

When an image is selected for Featured, RefinAI may grant a promotional reward in Refins, according to current product rules. The reward, when applicable, will be one-time per selected submission.

12. Commercial and professional use

Commercial use of generated images is permitted within the rules of the contracted plan and Terms of Use.

Before using an image in a commercial or professional context, the user must verify: whether they have rights to the original image; whether they have authorization from the client, owner, office, or involved third party; whether the image does not infringe on third-party trademarks, works, designs, products, projects, or rights; whether the image does not mislead consumers, clients, or partners; whether the image is suitable for the promised use, including advertising, portfolio, proposal, or presentation.

13. AI-specific liability limits

RefinAI is not responsible for decisions, losses, damages, rejections, disputes, infringements, publications, commercial promises, approvals, or consequences arising from the user's use of generated images.

Users must keep their own copies of important files and review results before any relevant use.

14. Reports, removal, and support

Suspicions of abuse, rights violation, unauthorized use of images, prohibited content, removal requests, or privacy requests can be sent to contato@userefinai.com.

RefinAI will evaluate requests and may remove content, deactivate links, suspend accounts, preserve evidence, or take other appropriate measures as warranted. Disabled public links stop new access through the public route, without guaranteeing removal of copies or screenshots made by third parties.

15. Changes to this policy

RefinAI may update this policy to reflect changes in the product, providers, laws, platform rules, AI features, or security best practices.

When there is a relevant change, RefinAI may notify users through in-app notice, email, or other appropriate means.
